There were many philosophies used in ancient china. However, there were three that are best known. These are Confucianism, Legalism, and Daoism, also spelled as Taoism. Each philosophy taught its own way to govern, and its own rules/way to live by. Though there are many differences between these three, there are also many similarities. For example, Both Taoism and Confucianism don’t require harsh laws to govern, while legalism encourages, and forces strong laws with harsh punishments.
Legalism was very different from the other philosophies. Its followers believed humans were born selfish and greedy and that there needed to be strict laws controlling the emperor’s people. Legalism was made by Hanfeizi, a Han prince. Hanfeizi believed that a ruler should use three tools to govern. Fa states that all the laws must be clearly written and put in a public place. Shu says that there must be secrets or tactics that prevent another person or people from taking the rule of the area. Shi, the third tool, states that the ruler or the emperor does not have the power, but rather it is the position that has power.

It was almost the exact opposite. Taoism was created mainly by a man named Lao Tsu, but he didn’t make it himself. Lao Tsu originally made the philosophy, but multiple people added on to it. He was an emperor’s librarian during the Eastern Chou dynasty. Lao believed that if you followed everything life brought to you rather than try to change your life, you would create happiness for yourself and everything in life would be much simpler. Lao also believed that every living thing shared a single life force, and unbalanced caused illnesses. For this reason, Lao thought killing was wrong, as it would destroy some life force, possible causing unbalance. He had revolutionary ideas about new relationships and government, different from many things that the Chinese people had ever seen. Another major belief system in Classical China was Legalism, which was technically a branch of Confucianism, and was surprisingly extremely popular (Carr). Legalism was very strict and built a code of law. The laws were generally harsh and discriminatory to women. Confucianism was the more popular and long lasting of the two. Daoism was also a notable belief system in the Classical Chinese time period. A possibly fictional philosopher and thinker named Lao Tzu created it. Daoism is partially a philosophy, but partially a religious faith just like most belief systems in this time. Daoists were much like present-day hippies due to their firm belief in the spirit world. Much like Confucianism and Legalism, this new idea was absolutely revolutionary and the Chinese loved it. They believed that respectfulness to the forces in everyday life and respectfulness to ancestors was the secret to being happy and free. In China during 406-221 BCE, the battling states between the Zhou and the Han Dynasties? were in a state of governmental disorder. Although the era was in a disruptive state, it ushered in a cultural opening that left a long lasting imprint on the Chinese history. As a result, three major belief systems surfaced Confucianism, Daoism, and Legalism in an attempt to achieve a sense of political order in a disorder period. There are distinctions in the way each of the belief systems approached the many problems that plagued the Chinese society. First, all of the founders were contemporaries in China. As well as considered philosophies, who studied the future, and sat out to focus on the present rather than the past. In contrast, Confucianism, Daoism and Legalism established various paths in search of an optimistic future for the success of China. Second, both Legalism and Confucianism developed a social belief system, but are considered a religion. Confucian and Daoist views were important for the shaping and development of mankind in the past. They were views that existed among the eastern Asian countries. They had both similarities and differences in the way they shaped out self-knowledge and self-cultivation. Also there was other outside forces that played a major role in their theories. Nature and art were said to have helped shape the human race as we know it.
Legalism was very different from both Confucianism and Daoism because Legalism was the belief that people needed to be controlled because they were evil. Legalism is found in China and was founded by Han Feize. While it is unknown when Legalism was established, it is known that Han Feize was born in 280 B.C. so that gives a general time when legalism started. Legalism didn’t deal with much religious concerns but was more of a political philosophy instead. Citizens were seen to be responsible for actions of one another. A person who is considered guilty, their relatives and neighbors should be punished as well. This was a way to make sure that the laws are followed. The laws are strict with harsh punishments. People who spy on others and report anything that they do wrong to the authorities are thought to be doing right of the law. Both Legalism and Confucianism are belief systems within a group of people, not religions, and both are intended to lead to an orderly way of life, how they approach their teachings are complete opposed.
The idea of ruling a powerful government based on the principle of using two conflicting ideologies at the same time appeared foreign to most dynasties of early China. In early Chinese times, after the Period of the Warring States, two ideologies emerged: Legalism and Confucianism. Legalism stressed a strong central government that expressed harsh laws while Confucianism had a decentralized government, placing trust in conscientious and learned individuals to work together to solve political issues. These two schools of thought were in stark contrast to each other and, up until the Han dynasty, had never been combined with each other through government policy. The Taoist philosophy is based on the teachings of Laozi and seems to have a more religious flow to it. Where as Confucian writings focus on the government and social order. Confucius believed that if a person behaved properly, then their family would follow suit, then their neighborhood, their city, and in time the whole country. The basis for a good system of government was the ideal Confucius family. Confucius talked about the 5 relations. They are emperor/subject, parent/child, husband/wife, older sibling/young sibling, friend/friend; all of which (with the exception of friend/friend) were based on the parent/child relationship. A large part of Confucianism is filial piety. The Superior Man, according to Confucian beliefs, is not only virtuous because of his actions but because of his attitude as well. This is why the Confucian belief that should the government behave in such a way the whole country will see this good and follow it.
Ancient China has three philosophies: Confucianism, Legalism, and Daoism. These three philosophies explain how people should behave and how the government should rule the people. The philosophies were guidelines to the people. Confucianism, Legalism, and Daoism have different values, beliefs, and ideas of what is important and expected, but the main goal is to work towards peace and harmony. These cultures are the same way in being rewarded due to their actions, but different in government regulation because of the people in command.
Legalists are in favor of an authoritarian state that is ruled by force. It claims that the supreme ruler is much more important than the ruled and that individuals must conform to standards of the authority. Han Fei mentions, (Doc 4), how people would not know how to run a government, saying how people are ignorant if they believe governing should be about the approval of people. By saying this, he feels like that ideology is the reason why those people can not find a major role. Han Fei also mentions, (Doc 5), that legalism was established for the purpose to make sure that everyone would take the brunt of their punishment, even if they are in a higher social group, and anyone can get their rewards as low as the commoners. Rulers who were well versed in their philosophies ruled their kingdoms in harmony. In China, laws played a big role in the everyday society. Laws during that period was very harsh. If someone had broken one of the laws, they would have been punished harshly. That was what Legalism was like back then. According to Legalism, laws had to be revised and have harsh punishments in order “to wipe out evil deeds”(Document 6). Legalism is an ancient Chinese philosophy of administration that believes that humans are more inclined to do wrong than right because they are motivated entirely by self-interest. Shi Huangdi was the founder of the Qin dynasty. After conquering the seven kingdoms in ancient China, he halted the Warring States Period and took the throne as the first emperor of the unified Chinese nation. He ruled on the basis of Legalism. To prevent criticism of his rule, Shi Huangdi ordered that all books that seemed to be useless or against him be burned. This included all poetry from the Chou dynasty and all books written by Confucian scholars. The only books from previous eras that Shi Huangdi let off were the practical ones about medicine and farming. Focusing on the issue of media censorship, the current Chinese government governs in a similar way to the way Qin Shi Huangdi once governed. China still blocks and monitor citizens access to several social media services and shuts down media entertainment programs during government events. While some may see this as an extreme form of censorship, we must consider the fact that several other countries have similar policies in place.
Amidst the chaos of political instability and constant warring of the Zhou era, arose many intellectual thinkers that brought such a profound impact in the fields of politics, religion, and philosophy. Even to this day, their influence can be seen on the many matters of China. Confucianism became the paramount school of thinking and later significant philosophies such as Daoism and Legalism gained immense recognition as well. Each party had their own proposals for creating an idealistic political society where the many problems they faced in their everyday lives could be eliminated. Legalism is based on a document titled “The Writings of Master Han Fei” that was written by Han Fei. Han Fei was a prince in the Han state of China. He was schooled with Confucian ideas and principles, but would reject them to create a more lawful society. Since he was a prince, he had a high social status and was in line for the throne of the state of Han after his father would pass. This gave him an advantage to implement his legalist ideas into the government because he would soon be ruler of Han. As the ruler, he would not be told that the legalist way of life was wrong so he would get what he wanted. Confucian ethics focused on groups, humans living in communities and in societies advancing human culture and civilization in harmony and balance with each other. Taoist(Daoist) ethics focused on individuals separate lives and personal moral advancement in harmony and balance with nature. Both Confucian and Daoists focus on cultivation of Wen and virtue of Te-power without force. Both also focus on a kind of humility. In Confucianism this is Chun Tzu; in Daosim it is humility to nature and natural order. Both honor the past, tradition, and ancestors, and both have a concern for the future. However, the
