The National Contract Management Association (NCMA) Code of Ethics outlines the responsibilities of NCMA members when conducting contract management duties. These responsibilities include demonstrating personal integrity, avoiding any conflicts of interest, acting in good faith, respecting confidentiality, and reporting unethical behavior. The PMI Code of Ethics is similar and provides principles of professional behavior, such
as respect, responsibility, fairness, and honesty.
Government fraud, waste, mismanagement, and misconduct regarding SBA Programs have been in the news recently. This includes reports of government officials using private jets or government planes rather than commercial airlines, as well as mismanagement of funds and improper use of funds. Such unethical activities have costly consequences and can lead to contracts and contract management being conducted in inappropriate and unethical ways. Contract managers must ensure that all contracts and contract management activities are conducted ethically and fairly.
Any potential conflicts of interest or ethical violations must be reported to ensure that contracts are conducted in a way that is fair and ethical. It is important for contract managers to understand the ethical implications of their decisions and to always act in the best interest of their clients and stakeholders. The news regarding government officials using private jets or government planes is a reminder of the importance of ethical behavior in contract management and the potential consequences of unethical behavior.
A recent case is the one of military contractors and an alleged fraud scheme for 7 million dollars. From September 2024 thru November 2016, they prepared and procured
deals for other companies. The quotes were higher than the real prices to guarantee the
sole-source awards. There were also false statements. https://www.justice.gov/opa/pr/military-contractors-indicted-7-million-procurement-fraud-

Over the years, the Red Cross has been guided in its use of donations by honoring donor intent. This policy helped the organization deal with a major ethical challenge after the terrorist attacks of September 11, 2001. The Red Cross received more than $1 billion in donations and initially diverted some money to ancillary operations, such as creating a strategic blood reserve. After donors objected, however, the organization reversed its decision and – honoring donor intent – used the contributions to directly benefit people affected by the tragedy. Should the American Red Cross have reversed its initial decision to divert some of the money donated for September 11 relief efforts to pressing but ancillary operations? Support your chosen position.

Mark Young is the head of the painting department in a large hospital; 20 union employees report to him. Before coming on board at the hospital, he had worked as an independent contractor. At the hospital, he took a position that was newly created because the hospital believed change was needed in how painting services were provided.
Upon beginning his job, Mark did a 4-month analysis of the direct and indirect costs of painting services. His findings supported the perceptions of his administrators that painting services were inefficient and costly. As a result, Mark completely reorganized the department, designed a new scheduling procedure, and redefined the expected standards of performance.
Mark says that when he started out in his new job he was “all task,” like a drill sergeant who didn’t seek any input from his subordinates. From Mark’s point of view, the hospital environment did not leave much room for errors, so he needed to be strict about getting painters to do a good job…

The U.S. Office of Personnel Management (OPM) is an independent agency of the U.S. government that assists other federal agencies in hiring new employees, conducting background check investigations, and managing pension benefits for retired federal employees and their families. The agency maintains data on millions of federal government employees, retirees, contractors, and prospective employees. These data were recently compromised in two separate but related data breaches at the OPM, raising concerns not only about potential identity theft and blackmail but also about the possible use of that data in intelligence operations launched against the United States.
Early in 2015, OPM discovered that the personnel data (full name, birth date, home address, and Social Security numbers) of 4.2 million current and former federal government employees had been stolen. Then, in June 2015, OPM announced that the background investigation records of 21.5 million current, former, and prospective…

Red Cross insurance company provide 8 million Americans with health-care financing. They paid millions of dollars for care attributable to illnesses related to tobacco use. In 1998, to recover some of this money, they sued the tobacco companies alleging fraud. They claimed that since 1953 the defendants conspired to addict millions of Americans to cigarettes and other tobacco products by misrepresenting the safety of nicotine and its addictive properties. The defendants’ success caused lung, throat, and other cancers, as well as heart disease, stroke, emphysema, and other illnesses to members of Red Cross plans, which Red Cross was required to pay.
At trial, the defendants asked the court to dismiss the case on the ground that the plaintiffs did not have standing to sue. Does Red Cross have standing in this case? ©

Global Crossing
The company was founded in 1997 to provide a trans-Atlantic cable to carry telephone and data traffic. Using high-bandwidth optical fiber, the company was able to sell capacity at less than half the price of existing competitors. After six months of operations, Global Crossing offered stock to the public, and the resulting price valued the firm at an astounding $19 billion. Six months later it was valued at $38 billion, more than the Ford Motor Company.
The cable technology was not proprietary and data-carrying capacity was a commodity. That meant that customers could easily switch from one supplier to another, putting them in a powerful bargaining position. Furthermore, customers were price-sensitive. Even worse, the threat of entry was high, and other companies were entering the business, fueled by easy financing. High fixed costs but near-zero marginal costs (the cost to carry one more piece of data) led to fierce price competition within the industry. As new…
