It prevents group health plans from denying coverage to individuals with pre-existing conditions and limits restrictions that a plan can place on benefits for those conditions. The title also aims to provide the right to individual policyholders to purchase health insurance if they meet certain criteria after losing group coverage. HIPAA's Title I plays a significant role in assisting individuals in obtaining healthcare by ensuring accessibility of their Protected Health Information (PHI) when needed. The Privacy Rule under Title 1 outlines requirements for granting access to an individual's PHI upon request, with covered entities being obligated to provide a copy or summary of the requested records within 30 days of receiving a request, unless an extension is granted due to complex circumstances. This provision allows individuals to obtain essential information for treatment purposes or when seeking care from a new provider. Furthermore, HIPAA's Title I grants individuals specific rights regarding their PHI, including the right to inspect and copy their records, request amendments, receive an accounting of disclosures made within the past six years, and restrict disclosures under specific circumstances. These rights empower individuals to take control of their health information and
make informed decisions about their care. In addition, HIPAA's Security Rule mandates covered entities to implement appropriate administrative, physical, and technical safeguards to protect electronic PHI from unauthorized access or theft, thereby preventing identity theft and ensuring the confidentiality of sensitive health information. In summary, HIPAA's Title I is crucial in safeguarding the rights of individuals by establishing national standards for privacy, security, and the confidential handling of PHI, ultimately providing individuals with greater control over their health information while ensuring its availability when needed for treatment purposes.
