Hello class, I chose to write about constitutional amendments. There have been many talks about a balanced budget amendment, since Thomas Jefferson in 1798. Most recently in January 2017, senators Mike Lee and Chuck Grassley introduced a measure that would consequently require congress to balance the budget. This measure would create an amendment that would make federal government expenses not to exceed its annual revenue. This amendment would also include that the federal government’s total debit for any year, will not exceed eighteen percent the GDP and require a two-thirds majority vote to raise taxes. This amendment would help stop the increase spending of the federal government. By not allowing them to spend more then what they are
I think it should be repealed because we are paying taxes and it goes to other things than the United States itself. For example, the government uses our money for things like foreign aid, useless scientific researches, and useless construction. Instead, we should be able to use the money how we want to in our local community. In article V of the Constitution, it explains how to get an amendment changed. In order to get it changed, 66% of Congress have to agree on it being added. The first step in amending the constitution would be to call a convention to meet with the Congress or the States. Both the States and Congress have the ability to make a change or propose an amendment. There are two part of Congress, the House and the Senate. The main difference is that decisions are easier to challenge in Senate and you have unlimited debate time in the Senate. The House also only has 435 members whereas the Senate has 100 members. After 66% of the House and the Senate agrees on adding the amendment, it then goes to the States, where 75% have to agree on it. After Congress have voted on the amendment and it has been passed down to the States, then they have seven years to vote on
The first ten Amendments of the Constitution are the Bill of Rights which is a formal statement announcing the rights that the people of the United States had against the government. At the time of its inception, the American people felt additional protection was needed from the federal government, especially after the Constitution was ratified. These protections were later extended by way of the ratification of the Fourteenth Amendment in 1868 (Davies, 1999).
I chose to write about the 27th amendment, which states that members of Congress cannot increase their salary until after there has been an election of representatives. The 27th amendment is a wise policy that keeps members of Congress from misusing their power, and it is obvious that the framers who wrote the law believed people were, by nature, greedy, and therefore included a safeguard against greedy actions.
There are a number of constitutional amendment(s) that are typically the focus of a number of issues with corrections and correctional policies and practices. One of the amendment(s) that is the focus of this is the Eighth Amendment which means that no one can be the subject of cruel and unusual punishment. This means that everyone should be treated equally and should not be beaten or tortured by the guards, must always be given food and water, and treated humane at all times which means that no matter what their crime was they are still allowed some form of protections by the guards to include being sexual harassed or sexual assaulted. They also retain their First Amendment right because they still have their freedom of speech and religion. Therefore, they must be allowed to practice whatever religion they believe in no matter how someone else may feel about it and they must have some time in order to practice this religion. However, there may be a number of other issues that may be raised but I feel the most important ones would be the Eighth and First Amendment because they are the biggest two that a lot of prisoners deal with in prison.
The framers of our Constitution knew that time has a way of changing countries and their citizens. Our country was in a whirlwind of change in 1789 as people were experiencing freedom from the tyranny of England for the first time in their lives. Our country was being molded and formed into a great nation by the founding fathers. Expectations and rules had to be set to protect the rights of the minorities and majorities. Amendments to the Constitution were written to ensure equality for all in changing times.
On the cold night of March 5th, 1770, a mob of American colonists were protesting outside the Customs House in Boston. One colonist threw a snowball hitting Private Hugh Montgomery. Montgomery replied with a shot into the crowd. This led the rest of the British Army soldiers to shoot into the crowd killing five people in an event that would later be known as the Boston Massacre (Foner and Garraty). After this protest, more and more taxes were levied against the colonies, particularly regarding tea. To add, trade with nations besides Great Britain was prohibited. These affronts were met with the tarring and feathering of British tax collectors and the infamous Boston Tea Party. As a result of this, Massachussetts was essentially ruled by martial law. This finally culminated with a declaration of independence by the Second Continental Congress on July 4th, 1776. The United States of America was formed.
In any given constitution a nation, the recording of bills of rights has been a gradual process. All the aspects of life in society were done with respect to the law. The society requires being guided by certain principles and guidelines that would define and evaluate each and every aspect of their lives. To ensure that the entire society remained focused and concentrated in the given policies and guidelines, they recorded in the constitution and made available to each and every member of the society for the purpose of doing reviews. The action of the people would be judged in accordance with the constitution. With society running several errands towards the realization of development, many fields had to be covered. Criteria for the operation of the people would require significant efforts to accomplish the set objectives. Violations in the society occur either due to misunderstanding or lack of awareness of the rights present in the constitution. Any form of violation is evaluated by the appropriate form of punishment offered. (Hand, 1965)
The Congress wanted to prevent misinterpretation and misuse of the Constitution by the government, and the people to trust the government. In other words, they wanted to make the laws clearer to understand so the people would understand and trust the government. To do so, they proposed additional declaratory and restrictive clauses to be added to the Constitution. With the people* in mind, the first ten clauses or amendments were ratified. Collectively, these first ten amendments are the Bills of Rights.
Congressional Reconstruction included the Thirteenth, Fourteenth, and Fifteenth amendments to the Constitution which extended civil and legal protections to former slaves. Congress abolished slavery in the District of Columbia in 1862, and President Abraham Lincoln’s Proclamation ended the practice of slavery in 1863, at war’s end in 1865 but the question of slavery had not been resolved at the national level.
Our founding fathers didn’t always trust the government and that is why they created The Bill Of Rights. In The Bill Of Rights are the first ten amendments to the United States Constitution. It was created to protect the individual's freedoms and prohibitions on governmental power. Amendment one, freedom of religion, speech, the press, and the right of the people to assemble peacefully. You were allowed to “attack” the government in a peaceful way by assembling and if that didn't work, That’s when amendment two comes in clutch. Amendment two, the right of the people to keep and bear arms. When peacefully assembling is not working to change the government, that is when the government is letting use the hard hand. That’s definitely always keeping
The constitution gives you amendments, and the first one gave you freedom of speech, and religion. The first one tells you what you are allowed to do like you can worship the way you want to, you can say what you want to, etc. I am going to give you two examples out of five from the freedoms they give you in the first amendment.
The fore father's spent many agonizing hours in the summer heat to ensure the future people of America would maintain liberty among other things. The people are supposed to run the government, not the other way around. The amendment proposes that people should be able to make their own decisions about what they choose to purchase. American's need to remember where they came from and look to where they are going. By ratifying this amendment, America is taking back control and stopping the government from forcing us to purchase goods and services from their or other dominating companies. Saying yes to this amendment brings America one step closer to the ideals we all dream about. The government cannot and will not tell the people how to spend
To amend the constitution, various steps and procedures must be taken. When either Congress (which takes a two-thirds majority vote in both the Senate and the House of Representatives), or a constitutional convention (which takes two-thirds of the State legislatures) want to propose an amendment, they give it to the National Archives and Records Administration. The Congress proposes the amendment as a joint resolution to the National Archives and Records Administrations Office of the Federal Register for the publication process. The Office of the Federal Register adds legislative notes to the joint resolution and publishes it in slip law format. The Office of the Federal Register also puts together an information package for the States
There are four ways to amend Constitution. One of the methods, also the most common method, is when the House of Representatives and Senate both must vote on the proposed amendment. According to the Constitution, for an amendment to pass it is required that the House of Representatives and Senate (which make up Congress) must pass it with a two-thirds majority. If it is approved by the two-thirds, then the proposed amendment is sent to the state legislatures for approval. It is required for the three-fourths of all state legislatures to approve the amendment. If it is approved, then the proposed amendment becomes ratified and added to the Constitution.
I believe that the most valuable amendment or change made in the Constitution is the first amendment because as it states, the first amendment forbids Congress from interfering with an individual's freedom
