1. Was Rob’s choice justified? Why or why not?
I don’t consider Robs choice justified because he based his decisions on Cathy being a smoker. His personal views on smoking should not be dictate who is the best candidate. I understand that he dislikes smoking, sees it as disgusting, sign of weakness of character and the impact it could have on health insurance but other health factors could cause the same thing. Both Cathy and Jen had the same amount of experience, references and interviewed well.
2. Is it fair for an employer to refuse to hire a smoker? What about an overweight person? (Are there any relevant differences between a smoker and an over- weight person?) Be sure to define what you mean by ‘fair.’
I don’t think its fair for an employer to discriminate someone for a position because they smoke or are overweight as long as it does not affect their ability to perform or affect others. Unfortunately, its is the business owner or manager who determines the image they want to sell for their business and what is best in the interest of the business or the services they provide. Depending on their line of work the position may require the person to be fit and someone who is overweight or smokes may not be able to perform certain tasks. …show more content…

Does the job position being filled-floor manager-make any relevant difference in this case? If not, can you think of a position where smoking would be relevant?
Floor manager position requires to lead by example in appearance, behavior and work ethics so smoking is irrelevant to their responsibilities. Being a smoker will not affect their capacity or their experience but their work behavior will determine if they are a good fit. As long as they do not abuse breaks or allow it to interfere with their duties it should not be held against them.
