I am interested in the concept of gender and the deeper meaning of being considered a transgendered person. I feel that a lot of people do not know or care to know about these topics on a more in depth level. People who close their eyes to the idea that a person could be born with the physical aspects of a male yet have the psychological aspects of a female and vice versa, tend to be the ones who say that those people are going against nature or god. Discriminating against people on the principles that their view on the matter is right and their main source of information is the bible. That does not stop most Americans from group up people who are transgendered or those cross-dress and those who are lesbian, gay, or bi-sexual into the same categories. This allows those more intolerant of social differences to justify discriminating people of transgender or gay backgrounds under the guise of religious views to deny employment or rights to use their services. Very much like what happened to African Americans in the 19th and 20th century. Like many other subcultures the transgender community faces discrimination. As of 2013 there are 33 states in America that have no state laws protecting transgender people from being fired from the work place. According to Wikipedia (transgender), a federal bill to protect workers from discrimination based on sexual orientation and gender identity – called the Employment Non-Discrimination Act – has failed to pass several times over the past twenty years. While there is no Federal law protecting against gender discrimination. There are a few states that have their own laws that prohibit discrimination based on gender; (California, Colorado Connecticut, Delaware, Hawaii, Illinois, Iowa, Massachusetts, Maine, Minnesota, New Jersey, New Mexico, Nevada, Oregon, Rhode Island, Vermont, New York and Washington and

Gender is defined as whatever behaviors and attitudes a group considers proper for its males and females. Unlike sex, gender is something that we learn from the day we are born. “Young children begin to acquire gender role stereotypes at about the same time they develop gender identity and by the age of 3 or 4 most children” (Amanda Youmans). Peers, community, media, religion and our upbringing all play a role in the understanding of our culture and what is considered acceptable for males and females. When the sex of a child is revealed, they are automatically placed into a gender specific role with certain expectations. There are things in this world such as colors, toys, media depiction and taught behaviors that play into these gender roles.
Since the beginning of their existence and in today’s society, the community of LGBT workers are not being treated fairly or getting their fair share that they deserve in the workplace. They are victims to high rates of workplace discrimination. Instead of being judged as workers and what they bring to their jobs and how they work, they are being judged by their sexual preferences and appearance. Being a gay or transgender worker causes them to be mistreated, not judged for the actual workers they are, and most importantly, halts a majority of them in better career and job opportunities. Although under federal law it is illegal to fire someone who is either gay or transgender, they are still either being denied employment or being terminated from their jobs because of their gender category or sexual orientation.
Transgendered people in America have made many great strides since the 1990s. They have encountered violence, lack of health care, and the loss of homes, jobs, family and friends. There have been many phases of the struggle of being transgendered in America over the years. The current phase we must be in now is equal rights. There are many variations of discrimination against the transgendered community. In our society we simply do not like what we do not understand. It is easier to discriminate than to try and understand. We are all created different and we should appreciate our differences. The change must come by addressing the views of the public. According to the article “Gender Identity Discrimination” (n.d), this occurs in the place of work when a company or its management makes a distinction in opposition to a worker exclusively because of their sexual characteristics or distinctiveness. This can include ceasing employment for a transgender staff member after the company/employer discovers the employee's gender distinctiveness or intended plan for conversion. This can also consist of rejecting a transgender employee’s admittance to the bathroom amenities at work that are accessible to other staff members. This may also include necessitating a transgender individual use the bathroom that is not constant with the person’s gender individuality or appearance. Also included in this form of discrimination is harassment or refusing to investigate claims of persecution by coworkers and management. Some citizens support the idea of laws and rules being passed in support of transgenders rights, but they believe that the federal government does not need to be involved. Transgender people are a diverse population of individuals who cross or transcend culturally defined categories of gender ( Bockting ,Miner, Romine, Hamilton and Coleman, 2013). The world is evolving and people need to become acceptance of others especially transgender individuals. According to (Krehely, Center for American process, 2009), LGBT people have made rapid progress securing equal right. Fifteen states now give same-sex couples at least the same rights given to heterosexual married couples. Regardless of the progress, however, members of the LGBT population continue to experience not as good as there heterosexual counterparts. (Krehely, Center for American process, 2009) Issues like low rates of health insurance coverage, (Krehely, Center for American process, 2009) and stress due to systematic harassment and discrimination, with the lack of competency in the health care system. Negativity from the health care workers toward LGBT people is due to the cumulative and intersecting impact, their reduced access to the social stigma that exists against LGBT people. Transgenders reports verbally and physically the get harassed and removed from direct contact with the heterosexual population.
Their have been current efforts to use disability law for trans people, in what is known as the “medical model” of disability, which relies only on medical diagnoses. In addition, the “medical model” has regarded disability as a biological reality of impairment, which could be a defect or sickness rather than an issue caused by the environment. In the past transsexuals have been successful in securing protections against employment, winning protections on the basis of disability though employment practice and sex discrimination claims. On the other hand, the medical model does have its limitations, and disabilities protections have failed were sex discriminations and sexual protections have excelled.
Discrimination is the root of the limitations that transgender individuals have. There have been recent issues in public bathrooms within that past couple of years. There was a lot of controversy over the idea of a transgender man or woman using their preferred restroom. People were concerned about the potential of rape, and other crimes which in my opinion is ironic because someone who is transgender has to worry about this daily just because they are who they are and people do not agree with it. The construction of a self-identity can be a very complex process that every individual is identity is developed through the lenses of cultural influences and how it is expected to given at birth. Through this given identity we are expected to think, speak, and behave in a certain way that fits the mold of societal norms. This paper aims to explain how gender perform gender roles according these cultural values. I intend to analyze the process in which individuals learned and internalized their respective gender identities, through their cultural background. I will be conducting a set of interviews with the intention to compare my experience as a self-identified male of Mexican descent, to the experience of another male character of Japanese heritage in order to understand how we come to self-identify as masculine in diverged cultures. In this paper, I argue that the construction of gender identities is a direct consequence of societal influential factors such as family values; values that reflect the individual’s culture. This analysis will not only utilize evidence from these identity formations, but also in explaining why and how these self-identities were constructed using both theoretical sources and empirical studies as a framework.
Transgender people are discriminated on an almost daily basis. They are discriminated in the workplace, as shown in a study commisioned by the Equalities Review. In a group of transgender people who have jobs and are prone to workplace-enviroment effects and opinions, “many respondents experienced harassment from co-workers and employers.” Nearly 29% of the group experience verbal abuse and harassment in the workplace enviroment, and about 4% received physical abuse. About 7% experienced threats, and about 27% experienced some sort of different treatment due to their gender non-conforming ways.(Whittle 38-39). In another study, it was found that being mistreated in the school years would have a negative effect on future outcomes relating to employment. “Those who were physically attacked in school were considerably more likely to stay in a job (64%) compared to those who were not (42%) (Grant 50).” They are also discriminated in public as well, adding on to the distress that many transgender people suffer from regularly, making it seem as if all transgender people are crazy. Transgender people are just more likely to be diagnosed as someone with a mental disorder because its helpful to see that those who have been diagnosed are “hurting and something needs to be done to help (Kreitler 1).” In
