Recently in Alabama a man by the name of Anthony Ray Hinton was exonerated from death row after already spending thirty years in prison. Hinton was convicted of two separate fatal shootings of fast food restaurant managers in Birmingham, AL. One on February 25, 1985 shooting a John Davidson, and the second occurrence was on July 2, 1985 making Thomas Vason the second deceased. The evidence brought against him was a revolver that somewhat matched the one Hinton had in his home. There was no physical evidence, no fingerprints and no eyewitnesses linking him to the crime. Also, the revolver was questionable at best due to the fact the gun belonged to his mother who he lived with. Ballistics could not accurately tell if the gun Hinton had was even the weapon used in the shootings because they could not tell if his gun had been fired out of recently. They also could not conclusively say that all the bullets used in the two shootings were fired from the same gun. All in all, Hinton was convicted by a possible bullet match to his gun; and an eyewitness’s testimony from a person who was present at a similar, but different crime that Hinton was never accused of. Hinton coming from an underprivileged area only had a $1,000 to hire a ballistics expert to disprove the allegations. Thus leading to a person whose proposed allegations were questionable. As I entered the court, the trial has already commenced so I did not really know how a real trial started. I sat in the back where the public sits, facing the judge bench. The courtroom was cold and quiet. Especially it was very small, much smaller and less impressive than I expected.. Everyone was in formal dressing code. On Saturday, September 12, 2015, I was assigned to the 6 Northwest as the security officer. At approximately 0500 hours while breakfast trays were being distributed in pod 100, an inmate, later identified as Kimmie Hawkins became insolent and advised me to get out of the pod. I immediately asked him whom he was talking to and simultaneously walked over to him to view his armband. As I reached for Inmate Hawkins’s left wrist, he snatched away from me, got in a boxing stance, and began bouncing rhythmically on his toes. Upon my arrival, I spoke with the victim in the case identified as Joe Rush. He advised me on November 20, 2015, at approximately 2:00 AM, he was hanging out with Allen Warren, suspect, and Samantha Henderson, witness. All three alleged criminals are being charged with the shooting death of William Jordan during a robbery. However, the U.S. Department of Justice has a criminal justice system that is not fair for everyone in the country, specifically for those who are mentally ill, or poor. The main factor that has been identify as the cause of wrongful convictions is eyewitness misidentification. The Bedau and Radelet’s study demostrates that there are around 350 wrongful convictions in capital cases. Their goal is to improve the current methods performed by our criminal justice system. Statement of Victim: Rush states that he knows the suspect (Lowe) from a year, so he borrowed $20 from him last month and paid him back last week, but today suspect confront him to pay his money back, for this reason they had an argument. Ricky has been in an accident which has left him in a persistent vegetative state. He has been in a coma for eight months and has “massive” brain damage. Ricky breaths on his own, he opens his eyes, moves around, but is unconscious. Ricky is also completely dependent on a feeding tube. No one can say if Ricky will come out of the coma, but if he does, he will not be the same person due to the brain damage; he will never be a functional adult again according to Ricky’s doctor, Dr. Saul Steinman.
