In this week’s assignment we are to evaluate the case study which involved Dr. Jones and determine what ethical violations may have experienced. We are then asked to specifically explain which guideline or guidelines can be applied to the case study. Finally we are to draw a conclusion of the case study. To summarize the case study Dr. Jones who is a forensic psychologist for the state psychiatric hospital was asked by the courts to complete a 30 day assessment evaluation on a 27 year old gentleman named Mr. Smith who has been detained and accused of murdering his girlfriend’s 3 year old child. Jones ended up helping in the conviction of Mr. Smith but this lead to some issues regarding and form of consent. In the section (6.03.03) titled “Persons Lacking Capacity to Provide Informed Consent” states that forensic practitioners who has established that the client lacks the capability to provide any consent it is the role of the forensic practitioner to make sure that the client is protected with their legal rights and welfare. The reason that this did not happen is because Dr. Jones had established that Mr. Jones suffers from auditory hallucination and was deemed incapable to stand trial yet she still used a statement that was overheard to use against Mr. Smith in court to have him convicted even though there was no consent provided to use this statement. When questioning the legal proceedings fortunately the assessment and observation that Dr. Jones did for 30 days was ordered by the courts which means that even though there was not informed consent it does not matter because the justice system over rides ones rights to give consent. In this essay today we will be exploring a case study where we have a young lady who has been stricken by a mental disability. We will be looking at the facts in which her disability was handled by a professional in the field of psychology. In Taney’s opinion on the Scott vs. Sanford case, he reasons why the court’s decision to refuse Dred Scott’s citizenship was the right one. Taney pulls from multiple sources, such as the declaration of independence, the constitution, and congress to void Dred Scott’s case. With a stoic tone, Taney meticulously tears Scott’s claim to shreds. Taney does not believe that Dred Scott is entitled to citizenship. On March 1, 2016 at approximately 09:30 AM, Jacklyn Thomas was at the Muskogee County District Court House in reference to a review hearing. Investigator Joe Poffel knew Ms. Thomas had two felony warrants out for her arrest through Muskogee County. Ms. Thomas was placed into custody after her court hearing without further incident, and was transported to the Muskogee Police Department to subsequently be interview on an additional case involving Ms. Thomas' children. After the interview, Ms. Thomas was taken to the Muskogee County Jail.

The patient visited the clinic on 03/01/2017 after experiencing these issues for approximately two months. He is experiencing fatigue with not being able to achieve adequate sleep during the night due to nocturia. He is complaining of bladder always feeling full after voiding. I feel that Dr. P has a case in this situation. I feel he has the ability to sue for compensatory damages. I would argue that Dr. P is a public figure. As you said he is the foremost academic on exposure to violence and the human psyche. Since he is a public figure and his work is important to public interest. Because of this we have to prove malice. In this case we also have to determine how defamation of DR. P is present. We have to answer how his reputation is being harmed, how his standing in the community is being harmed.
Because of the doctors’ profession, a psychiatrist must abide by the ethic of nonmaleficence when it comes to their patients. This article is true, “When conflicts occur among psychologists’ obligations or concerns, they attempt to resolve these conflicts in a responsible fashion that avoids or minimizes harm” (Ethical Principles of Psychologists and Code of Conduct, n.d.). For this profession, this is very important because their judgment can have a serious effect on a person mind. If there were no ethics to guide them not to do no harm, psychology could become an unethical profession within the health care system. This ethic could also be the reason for the raise of concern that Dr. McHale has for the detainee.
