Decriminalize The War On Drugs

I hope you all can agree that a better idea would go after the source of the drugs or even the treatment of the people using them and hopefully in time the number of people using narcotics drops dramatically. But realistically what happens is people using and distributing narcotics are entered into a never ending life of crime because the government punishes the criminal offenders’ absurd amounts that the government knows they cannot afford. So once released from prison or jail these criminals have debts that they have to repay and no way to pay them. So what is the answer? Crime is the answer. That is where the cynical cycle starts all over again and these released inmates find themselves in a familiar situation; trying to make money for reasons that don’t benefit themselves. But, unfortunately, the only way these people know how to make money is deemed deviant by society.

Even the U.S. is considering loosening up on drugs right now, over half of americans support marijuana for its recreational and medicinal purposes, it’s already been legalized in two states so far, setting up legalization for more states in the future (Huey). Huey also claims- “Drug reformers nationwide continue to argue that legalization will free up more resources to fight harder drugs, deny traffickers billions of dollars in profit, and generate tax revenues for prevention and treatment through state-controlled marijuana sales” (Huey). If there are more resources to fight harder drugs than funds used only to punish minor drug felons, there would be a lot less problems with the prison system and inmate

Harsh, cruel, and unusual is an understatement to the punishments given to drug dealers for their drug related offenses. Mandatory minimum drug sentencing was arguably established to target higher level drug dealers but recently the majority of cases have been low level drug dealers. Distributing narcotics is a serious offense, but do these people who are trying to support themselves, a family, or an addiction deserve to spend close to a lifetime incarcerated?

There is a debate in the American government system on how to handle the use of drug and alcohol. In the 1960s drugs were uprising along with youth rebellion and in 1971 Nixon declared a “War on Drugs” (Citation a brief). This name is not to be confused with the band War on Drugs, but the term is still popularly used to describe the policies that Government officials are making regarding drugs and alcohol. This debate got reheated when Colorado legalized weed for medical and recreational use, followed by several other states. There has slowly been a shift in mindset from, “alcoholics are drug addicts are all criminals and we (the law) should throw them in jail” to “addiction is a disease.” Even the way that addicts/alcoholics are treated has changed to treatment centers with specialist versus throwing them in the hospital to detox and hoping for a change. Policies that are shifting the penalty from incarceration to treatment reflect these changes and help the individual suffering from the disease to get back on their feet. The war on drugs rings on, but changes are being made.

The fact that the United States treats drug use as a terrible crime instead of treating it as a physical problem or illness, and the drug problem is still not going away, shows that the United States is going about drug abuse all wrong. The United States has over 25% of the world's incarcerated population and over half of those are in prison for drug abuse/distribution. Other countries have decriminalized drugs and have seen an extremely positive difference in the drug abuse problem. Therapeutic drug treatments can be offered as an option to drug abusers so they feel safe and not afraid or angry of what is happening. The United States needs to find a new policy on drug abuse because the current policy has failed.

As many African-Americans were rejoicing their long and strenuous journey, a new plan was afoot for them: the war on drugs. The war on drugs is unequivocally the biggest and most durable war this country has ever fought against its own citizens. Like any other wars the United-States has engaged in, the war on drugs is remarkably different; it was fought internally, and intended to target a specific group, people of color. Their communities, houses and churches were flooded with law enforcements, constantly checking for illegal possession of drugs. They were branded criminals and were continuously being thrown in jails or prisons, with harsh and lengthy sentences imposed on them. And once they were released, many are saddled with huge debts

America is the land of the free; it’s ironic that America also by far has more incarcerated citizens than any other country in the world. America is at war. We have been fighting drug abuse for almost a century. In 1972 president Nixon declared a war on drugs. Unfortunately, we are not winning this war. Drug users are still filling up our jails and prisons, now more than ever. The drug war causes violent crime and criminal activity due to prohibition, not the drugs themselves. Children in all of this are left neglected or without parents. The only beneficiaries of this war are organized crime members and drug dealers. The United States has focused its efforts on the criminalization of drug use. The government has spent billions of dollars in efforts to rid the supply of drugs. Even with all this money and effort of law enforcement it has not decreased the demand or supply of illegal drugs. Not only being highly costly, drug law enforcement has been counterproductive. Current drug laws need to be reviewed and changed. The United States needs to shift spending from law enforcement and penalization to education, treatment, and prevention. The war on drugs has caused many problems in the United States, family problems, financial problems and has increased crime, after forty years in this war it’s time for a change.

There are groups of people in the criminal justice system who considers drug addiction a personal issue, not a criminal one. This could not be further from the truth; drug abuse is illegal and should be treated as such. It is a catalyst for many crimes seen today from mugging to murder. If the numbers of those who abuse drugs are reduced, the amount of crimes associated with the addiction are also reduced. Not only will crime levels be reduced, most of those who undergo treatment tend to be better prepared to do more with their lives and not re-offend.

Secondly, Incarceration is not a substitute for treatment and the seeking of treatment should be a personal choice. It is mentioned on multiple sources that more than half are in prison in relation to drug convictions. According to my opinion, drug use is a personal choice unless it leads to other crimes such as violence, theft or sexual abuse. I am aware that a lot won’t seek help, so it is our jobs as peer’s to motivate them to do so. It can’t be forced upon them. However, since most people aren’t in agreement with drug legalization than possibly decriminalization needs to be done. The worst part is about 95 percent of the drug abusers released return to their addiction and 60-80 percent re-offends through the motivation of their addictions

One of the most profound problems that plagues our society is drug addiction. With drug addiction comes those who offend and have run-ins with the law. Our country deals with these drug-addicted offenders by placing them in jails for a year or longer, only to have them come back out to society when their sentence is over. They are still drug-addicts and so they return to the street only to commit yet another crime. From here the cycle of crime, arrest, jail, and return to society continues, solving absolutely nothing. Therefore, placing drug-addicted offenders in jails fails to confront the major problem at hand which is that of the drug abuse. Drug abuse and crime is not a new concept and the statistics around the problem have continued to rise. According to (Office of Justice Programs, 2011), there were an estimated 1,846,400 state and local arrests for drug abuse in the United States. Additionally, 17 percent of state prisoners and 18 percent of federal inmates said they committed their current offense to obtain money for drugs (Office of Justice Programs, 2011). Based on this information, we can conclude that our criminal justice systems are saturated with drug abusers. The United States has the highest imprisonment rate and about 83 percent of arrests are for possession of illegal drugs (Prisons & Drug Offenders, 2011). Based on these figures, I can conclude that we should be more concerned about solving the drug abusers problems and showing them an alternative lifestyle rather than strict penalty of long term incarceration which will inevitably challenge their ability to be fully functioning citizens after release.
