The United States is currently governed under a federalist constitution and has a deep rooted history of setting up its constitution to accommodate transparency, checks and balance and prevent tyranny. The federalist system of government is divided into the co-dependent central and state government. federalism in the united states give states the power to create their own laws, constitutions, and government structures. As stated in the U.S. Constitution (U.S.), enormous reservoirs of political power are thus derived from the people who reside in the states themselves. (champagne 2017) Texas and California are two states in the US that are comparable in terms of their population, resources, size, economy and constitution. The Texas Constitution is the foundation of the statehood of Texas within which the government operates in the same way that U.S. constitution governs the affairs of the whole country with its allocated power. The Texas constitution has a huge influence on the daily lives of Texans Possibly even more than the U.S. Constitution. Although all states have its own constitution, Texas and California have different ways in which they gained their constitution. Like most state in the U.S. The state of California gained its constitution after the civil war, the constitution was ratified in 1879 and It is similar to the Texas constitution in many ways. Both constitutions are founded on the unanimous vote of its people and are grounded by the rule of
In the Unites States of America Federalism is the basic structure of the American government; it is the distribution and balance of powers between the National government and the States government. In order to obtain a compromise between those who wanted stronger state government and those who preferred a stronger national government the founding fathers arranged and settled for a federal system rather than the alternatives of a unitary or confederal system. While both National and State governments each have specific powers and authority, they also share certain powers and must be able to cooperate effectively with each other.
Texas has been through a lot of changes and constitutions. After constants debates of what the constitution should be, the current Texas constitution was established in 1876 and is the 7th constitution Texas has had. It created 3 branches of government: Legislative, Executive, and Judicial. The current constitution has great qualities, but it also contains a lot of weaknesses that shouldn’t be ignored for the sake of pride.
In the Texas Constitution it talks about information that just deals with Texas alone, that the U.S. Constitution doesn't have. For one, it talks about Education. Explaining how it shall be the duty of the Legislature of the state to establish and make suitable provisions for the support and maintenance of an efficient system of public free schools. The Texas Constitution also includes information about corporations, municipal and private. It has the Spanish and Mexican Land titles under it which no other state has in their constitution. And finally the Texas Constitution establishes rules concerning railroads.
The constitution of 1824 required that each state make their own constitution, and Coahuila and Texas was formed as a single state under the federal republic of Mexico
The Texas Constitution and the U.S. Constitution is very similar to each other in terms of structure. Both documents provide framework, and the amendments come from the will of the people. The Texas Constitution was written to govern the the individual state alone so it should be more specific and less flexible to change. On the other hand, the U.S Constitution is more flexible than the Texas Constitution because of the fact that it was designed to be governing a total of fifty states with each individual states differing from others in values, beliefs, attitudes, behaviors, and the states consist of individuals who have similar values. Today, we are still operating under the 1876 Constitution with four hundred ninety-one amendments, which includes a preamble and seventeen
The Texas Constitution has evolved in many ways throughout history. Before the current constitution there were five predecessors. There were many factors that effected each of the five constitutions. After very long governance by Spain and Mexico and a small war with Mexico, the Texans finally won their independence. The first constitution had become official in September of 1836. This first constitution was called the Republic Of Texas Constitution. After struggling for about nine years to become apart of the Union, Texas’s second constitution was created. The Second constitution was called the Statehood Constitution and was thought to be one of the best constitutions of time. The Jacksonian Democracy greatly influenced the Statehood Constitution. The idea of the Jacksonian Democracy was to increase the people’s participation in the government. This Constitution lasted about 16 years until Texas joined the Confederate Sates of America in 1861. This third constitution was called the Civil War Constitution. The main goal was to modify the
On September 17, 1787, the U.S. constitution was signed. The U.S. constitution is a document that has a set of rules, guidelines, and principles that governs our nation. This constitution is the oldest written national document and has had 27 amendments. The current Texas constitution is the seventh document written for Texas. The previous six were all when Texas was still apart of Mexico. The current constitution hasn’t been revised since 1876, which makes it the longest state constitution in the United States.
In my analysis of the Texas Constitution I will assess the three branches of our State Government, the Legislative Branch, Executive Branch and finally the Judicial Branch. Our State Government resembles our National Government in various ways but also in very different ways which we will review in this essay. I will identify a handful of criticisms and problems associated with the provisions in each of these branches of our State Government and identify suggested reforms that many feel are needed.
From numerous points of view, the U.S. Constitution and Texas Constitutions are very much alike. They both epitomize the standards of delegate equitable government, in which power shows from the general population. Both contain a bill of rights that shields common freedoms from government violation. Both accommodate a dual council with a House of Representatives and a Senate. Also, both look for an arrangement of balanced governance and partition of forces between administrative, official, and legal branches of government. Not to mention they both divide government control amongst upper and lower levels of government. In the U.S. Constitution, the states are subordinate to the federal government, and in the Texas Constitution the regions are subordinate to the state government. Be that as it may, even with these general components, the two constitutions are very different as well. These distinctions result from the way
The U.S. Constitution and Texas Constitution have numerous differences. As mentioned in our textbook, key differences between the two constitutions include how frequently they are amended, the difficulty of the court system, flexibility with allowing the government to act, and the strength of office. The U.S constitution is rarely amended, with a relatively simple court system. It is also more flexible with allowing the government to act, while maintaining presidency as a strong office. While, the Texas constitution is amended frequently, with a complex and confusing court system and weak governorship office.
In the comparison of Texas to New Mexico, it can be believed that they share very common political views being neighboring states but that quickly diminishes when taking a closer look into their differences between political cultures, the state constitutions, and the branches of their government including legislative, executive, and judicial. The two states also differ in the issues that they face but they share many as well mainly due to their close proximity to the Mexican-American border.
The Constitution of the United States is the central part of America’s government. For 200 years it has guided the evolution of governmental foundation and has provided the basis for political stability, citizens’ freedom, economic growth, and social progress. The states and central government have had problems but still have compromised to keep their relationship strong. The Framers of the Constitution created a federal system with a national government strong enough to unify the states in their pursuit of common goals. The central government shares powers and responsibilities declaring it a federalist country.
As far as the Texas Constitution in comparison to the U.S. Constitution, they are much different. There has always been much talk about how the Texas Constitution is very long and poorly put together. I believe Texas and the people in it have tried to keep Texas very traditional and old school as possible. In my opinion, they have continued to add things to the Constitution to keep away from progressivism and to not allow the U.S. government to dictate what they will and will not do. There is always positive and negative that comes with going against the majority. I have lived here all my life and never really knew the difference between our state and others until recently. Native Texans do believe that Texas is bigger and better than any other state and with that the elite politicians try to make sure every other state knows it by continuing to keep a republican office in Texas. As far as the Supreme Court goes they have also found ways to be as different as possible.
Federalism can be viewed as the current constitutional foundation for the United States of America. This structure of government provides our country with a fortified relationship between each individual state and the national government. Prior to the U.S Constitution, the United States government operated under the Articles of Confederation, which outlined the United States previous federal system. The system provided in the Articles failed due to limited central power and unorganized leniency in the states. This pushed Americans to implement a revised version of these articles, which first introduced a stronger federal government to the people in a document we now know as our Constitution. America was among one of the
The United States has a deeply rooted and embedded tradition through the Constitution of having a federalist style of governing as its structural framework for operating and guiding the government of the country. The form of governing is best described as a balance between powers of the central government and the powers of each independent and autonomic state. “Federalism is a system in which the power to govern is shared between national and provincial (state) governments, creating what is often called a federation” (Wikipedia 1).This style of governance has not been the only structure instituted in American history in order to implement civilized law and order among the people of the land. Prior to the
