Generally, workers’ compensation cases for medical providers settle around 50-70% of the billed amount. This obviously depends on the items billed, modifiers used, and other specifics in the case. For this case, I would recommend going back to the adjuster to see if s/he has more authority. There is certainty no harm to counter-offer. At some point however, the adjuster will send it to local counsel. Then, it might take longer for the case to resolve because it takes additional time for the file to be sent to counsel, having counsel file an answer, for our office to send a demand letter including documentation, etc. Essentially, it’s going to increase the time before settlement can be reached and payment issued.
