Argumentative Essay On Mass Incarceration

Mass incarceration is an issue that defines us as a society. Today, the United States of America makes up about five percent of the world’s population and has twenty-five percent of the world’s prisoners. Also, one of every one hundred adults are locked up, and one in every thirty-seven adults in the United States is under some form of correctional supervision: in addition, African Americans are incarcerated at more than five times the rate of whites. Young black people went through many difficulties; however, they are still called super predators by Hillary Clinton. One of many difficulties is the African slavery, although it was over a century ago, it left a scar and a horrible memory in everyone's mind. All the phenomenons that occurred in our country during the last century gathered thoughts and escalated the problem of mass incarceration which made the people including the police look differently at African American people. I am against the mass incarceration issue. Opposing Donald Trump, I think we should reduce the number of people behind bars with cautions, because It is a complex subject that has many causes and effects in the long term to the people inside and outside the prison.

Michelle Alexander’s book, The New Jim Crow: Mass Incarceration in the Age of Colorblindness, examines mass incarceration in the United States, why the criminal justice system works the way it does towards minorities, the detriments associated with mass incarceration as it relates to offenders, and much more. In the introduction of her book, Alexander immediately paints the harsh reality of mass incarceration with the story of Jarvious Cotton who is denied the right to vote among other rights because he, “has been labeled as a felon and is currently on parole” (1). Other information Alexander presents in her introduction are her qualifications as an author of the book, and gives a brief summary of each chapter and how each one is laid out. Her qualifications are she is African-American civil rights attorney with the American Civil Liberties Union (ACLU) and is also an Associate Professor at the University of Stanford Law School. From a critical standpoint, Alexander seems very qualified to write on the topic, being part of the marginalized group and also being an expert in the legal field of which the topic covers, enhances her ethos to where one could consider her an expert in mass incarceration topics, as they relate to African-Americans. Overall, the introduction of her book does a great job starting out giving a stark reality of topic at hand, giving brief statistical references about mass incarceration in the United States, and giving an outline for her book.

Mass incarceration is one of very many huge problems we have here in America. But when you really look into the core of the situation, whose fault is it really. Right away you think it is the criminals fault for getting arrested in the first place right? More people should be well behaved and not end up in prison? But what a lot of people fail to notice are the ones that actual do the actual sentencing. In Paul Butlers book, Lets Get Free he writes, “I became a prosecutor because I hate bullies. I stopped being a prosecutor because I hate bullies.”

Mass incarceration became a public policy issue in the United States in the early 2010s. Now in 2016, there is still much debate over the country’s incarcerated population and incarceration rate. The nation has the highest incarcerated population in the world, with 2,217,947 inmates, in front of China with 1,649,804. America incarcerates 693 inmates per 100,000 residents, only the African island nation Seychelles incarcerates at a higher rate, with 799 for every 100,000 residents. The problem of mass incarceration continues to be assessed in various contexts. Recent analyses are historian Elizabeth Hinton’s From the War on Poverty to the War on Crime, legal scholar Michelle Alexander’s The New Jim Crow, and criminologist Dr. Elizabeth Brown’s “Toward Refining the Criminology of Mass Incarceration: Group-Based Trajectories of U.S. States, 1977—2010.”

Though most citizens in the United States would agree that the prison system in the U.S. needs to be amended, do they see the prison system as a way to enforce the racial caste system? At first Michelle Alexander, the author of The New Jim Crow, did not see the prison systems as racially motivated until doing further research. After researching the issue, Alexander found the prison system was a way to oppress African Americans and wrote the novel The New Jim Crow. The New Jim Crow follows the history of the racial caste system and in the novel Alexander comes to the conclusion that the mass incarceration of African American is the New Jim Crow, or in other words a new system of black oppression. Though some might try to refute the idea of mass incarceration of African Americans, Alexander offers a well thought out argument with substantial evidence and data to compellingly link Jim Crow and mass incarceration and proves that it is an issue that should be on the radar of all U.S. citizens.

The New Jim Crow: Mass Incarceration in the Age of Colorblindness is a book by Michelle Alexander, a civil rights litigator and legal scholar. The book discusses race-related issues specific to African-American males and mass incarceration in the United States. Michelle Alexander (2010) argues that despite the old Jim Crow is death, does not necessarily means the end of racial caste (p.21). In her book “The New Jim Crow”, Alexander describes a set of practices and social discourses that serve to maintain African American people controlled by institutions. Research indicates that mass incarceration has always worked to the detriment of African Americans, especially the low-income earners (Western, 2006). The aftermath of this trend is that the employment prospects of former felons are significantly diminished (Pager, 2007). Felon disfranchisement in turn distorts the local and national politics of the county (Uggen, 2006). America has a major problem with overcrowding in its prisons, and action needs to be taken. Since 1970, the inmate population in the United States has increased over 700%, far greater than the general population as a whole. This has led to declining quality of life within the prison system including 8th Amendment violations and it represents a needless drain on state finances. There is simply no value in keeping non-violent convicts in the prison system, sometimes for years. The costs are high, and there is very little benefit to America. The justice system needs to be overhauled to relieve the massive crowding in US prisons.

Mass incarceration has been an ongoing problem in America that became prevalent in the 1960s and still continues today. The reason this mass incarceration is such a crisis in our country is because it has been ripping apart the family and impacting all those involved. This epidemic affects those of every race, but more specifically, African Americans. Many researchers attribute this prison boom to police officers cracking down on crime, but only focusing on the inner city which is often times it is made up of a predominately black population. Because of this, America saw such a rise in the number of African American males in the system in at least some way; whether they were in prison, jail, or probation the numbers were astounding. When a father is removed from a home it impacts the family whether that is the wife, girlfriend, child or stepchild, it has proved to have some short and long term psychological affects on them. It is impossible to parent behind bars, so all the parenting is left up to the mother while the father is locked up. In addition, when a person goes to prison it leaves a mark on the inmate as well. Mass incarceration among African Americans is an ongoing problem impacting thousands of people, both directly and indirectly, and because of this, it is breaking apart the family structure and taking a psychological toll on the loved ones involved.

Michelle Alexander’s The New Jim Crow: Mass Incarceration in the Age of Colorblindness goes into great detail on race related issues that were specific to black males, the mass incarceration, and how that lead to the development of institutionalized racism in the United States. She compares the Jim Crow with recent phenomenon of mass incarceration and points out that the mass incarceration is a network of laws, policies, customs and institutions that have been working together to warrant the subordinating status of black males. In this paper I will go into a brief examination of the range of issues that she mentions in her book that are surrounding the mass incarceration of black male populations.

The literature concerning of Mass Incarceration is relatively new; and when discussing racism most scholars have focused the discussion on matters of Jim Crow or Slavery. Mass incarceration or Mass Imprisonment, is defined as a rate of imprisonment that has reached numbers that are above the historical norm. Mass Incarceration is a term most sociologists used to describe the extremely high rate in which the United States has imprisoned individuals, and its impact during the 21st century. In contrast, according to Gilda Graff author of “Redesigning Racial Caste in America via Mass Incarceration”, she describes Mass incarceration as a new tactic in the history of racism. In the eyes of many, mass incarceration constitutes a brutal technique of punishing individuals for excessive periods of time. There are many reasons to be doubtful that the system of mass incarceration has helped the nation in any form. Rather, locking up millions of people for nonviolent crimes seems just too excessive and redundant. According to “The Black Family in the Age of Mass Incarceration” by Ta-Nehisi Coates published in The Atlantic magazine, the majority of those incarcerated are minorities mainly African American. More clearly, the technique of mass incarceration is used to limit the numbers of minorities in society or control the minority population. Regulations regarding incarcerating millions must be reviewed thoroughly on a federal level and refine precedent to a better future. What major actions must be taken into account to change the turmoil of mass incarceration? Is it possible to adjust the law in reparation for a better future?

In the 1980’s and 90’s at a time when crime was in decline throughout the United States poor neighborhoods saw the beginning of what would soon become the great tragedy of mass incarceration. The topic of drugs had become a media sensation and political parties battled on which side could be the “toughest” to solve the pestering issue. Images of African Americans hooked on crack aired across televisions, newspapers and tabloids nationwide. Though crime rates were down, government used the media blast to gain funding of over two billion dollars to fund the DEA and local police forces in sweeps that would fill American prisons in numbers unprecedented in world history. Targeting poor and mostly African American neighborhoods, arrests made during this era conjure memories of Jim Crow racism and Convict Leasing leaving many of the convicts or even merely accused marred in an infinite loop of struggle inside and out of the prison system.

What is mass incarceration? Mass incarceration is the process by which people are brought into the criminal justice system and put in prison. Since the 1970’s, incarceration rates in the U.S have risen at an exponential rate and are at an all time high today. In the 1970’s President Nixon declared a war on drugs. This war lead to massive police force and prison expansion. The law cracked down hard on on all drug offences, and in 1986 established mandatory minimum sentencing guidelines for all drug use. According to the American Civil Liberties Union, “nearly 50% of all prisoners in state prisons are locked up for nonviolent crimes”[3] such as drug use. The time spent in prison in the U.S is, on average, longer than that of all other countries that incarcerate people who have been convicted of crimes. Despite the U.S housing only about 5% of the world's population, it accounts for nearly 25% of all incarcerated people in the world. The rise of mass incarceration in the U.S has led to serious racial, economic and social problems.

In The New Jim Crow: Mass Incarceration in the Modern Age of Colorblindness by Michelle Alexander, the author argues the legal system doing its job “perfectly” well—the United States has simply replaced one caste system, the Jim Crow laws instituted in the 1880s and designed to oppress recently freed black slaves, for another—a system which uses the War on Drugs, which was instituted in the 1970s, to imprison, parole, and detain people of color, keeping the majority of minorities in the United States in a permanent state of incarceration. This an important issue because it affects the everyday lives of people around the nation. Alexander looks in detail at what economists normally miss—the entire legal structure of the courts, parole, probation and laws that effectively turn a person who may have done the crime into a person who is unworthy or “incapable” of rehabilitation. Alexander does a wonderful job of telling the truth, and blaming the right people, who can be liberal or conservative, white or black, who inflict this injustice on others. Alexander’s writing, however, does lack a structure that the reader can follow, which ultimately weakens her overall case.
