New Jersey has a mandatory overtime law to protect the health, safety and wellbeing of not only employees but patients as well. It states working overtime must be voluntary and refusal to work overtime cannot be grounds for any consequence to the employee. 2. Think of a specific example of an “unforeseeable emergent circumstance” that would allow a New Jersey hospital to require a nurse who is an hourly employee to work more than 40 hours per week. An example of an “unforeseeable emergent circumstance” that would allow a New Jersey hospital to require a nurse who is an hourly employee to work more than 40 hours per week would be during the pandemic. Covid-19 required many nurses to work overtime due to being short staffed and not having safe staffing ratios. Due to so many patients in the hospitals, nurses may have had to work more than 40 hours a week. 3. Can a hospital nurse in New Jersey (who is an hourly employee) agree to work more than 40 hours per week if they want to do so? Yes, a nurse in New Jersey can work more than 40 hours a week, but only if it is voluntarily. 4. New Jersey has a law that provides an Alternative to Discipline Program for nurses. It allows an impaired nurse (for example, a nurse with an addictive disease or a mental illness) to avoid discipline (for example, license suspension) by the Board of Nursing. Why do you think New Jersey has such a law? I think New Jersey has an Alternative to Disciple Program for nurses to provide a fair chance to the nurse to rectify impaired behavior. Addictive substances and mental illness can be an issue in all job fields, including nursing. Especially in nursing, it is important to maintain a safe environment for all patients. This program works with employers and offers education to nurses, employers and the public which helps maintain a safe environment for patients and nurses. 5. List two things NJ hospitals (covered health care facilities) must do under the New Jersey Violence Prevention in Health Care Facilities Act. Two things NJ hospitals must do under the New Jersey Violence Prevention in Health Care Facilities Act is that they must identify workplace risk, another one would be proper training to staff to be able to identify warning signs such as aggression and possible violent behavior. Essentially identifying workplace risk could make an employee aware of their surroundings if the location is in a high crime rate area. Another thing is that An employee that is able to notice early signs of aggression could decrease the likelihood of violence escalating.
6. What does the most recent published data (2016) from the CDC indicate about the following healthcare associated infections (HAIs): hospital-onset Clostridium difficile (C. Difficile)? According to the CDC, after collection of data from more than 23,000 hospitals, there is about a 8% decrease in C. difficile infections compared to 2015. Most of the isolates collected in the metropolitan area. Within the isolates, there were 138 different ribotypes found. While 106 was the most common ribotype among the community-associated, ribotype 027 was the most prevalent among health care. 7. What does the most recent published data (2016) from the CDC indicate about the incidence of overall catheter-associated urinary tract infections (CAUTI)? According to the CDC, there has been a decline of CAUTIs from 2012-2016. 8. Name the two branches of the government that are involved in the process of how a bill becomes a law. The two branches of the government that are involved in the process of a bill becoming a law are the senate and the general assembly. 9. After reading Covid-19 FAQs from the State of NJ/Department of Law & Public Safety, define Law Against Discrimination (LAD). The Law Against Discrimination (LAD) is an anti-discrimination law. It is designed to protect individuals from being discriminated or harassed based on characteristics such as race, religion, gender, sexual orientation and disability. This Law is not only for employment, but for housing and public accommodation. Essentially, the goal of this law is to ensure equal rights for everyone. 10. If you have been placed in isolation or quarantine due to Covid-19 infection, can you be fired from you employment? Explain your answer No, Governor Murphy signed a law in March of 2020, that prohibits an employer from firing an employee that has Covid-19. This is only right since Covid-19 is contagious and can make others in the workplace sick. Although proof is required, you will not be fired for your illness, and can complete the quarantine period without fear of losing your job.
