In this type of situation, based off of what the Texas Administrative Code (TAC) (2023) states, I would respond with letting the previous client know that while I appreciate the pleasant memories of our counseling sessions, it is important to emphasize the previous therapeutic relationship that was established was based on professional boundaries and those boundaries need to be upheld. TAC (2023) rule §681.38 D.3 states that a licensee is not to engage in a relationship or sexual contact with a client within 5 years after counseling sessions have ended. Professional counselors need to ensure that they are maintaining fidelity in the client/counselor relationship. What that means is that the counselor is maintaining their loyalty, faithfulness, and honoring commitments with their clients by abiding by the ACA code of ethics in all interactions with their clients (Erford, 2017). I would further my response by letting the previous client know that as a professional counselor, engaging in sexual or romantic relationships with former clients is an ethical code violation. This ethical code has been put into place in order to maintain the therapeutic process and avoid any possible conflicts of interest. The American Counseling Association (ACA) code of ethics (2014), A.5.c. states that these types of relationships with former clients require 5 years following the last professional contact, demonstrate forethought and document in written form if the relationship could be viewed as exploitive at all, and whether there is any potential for harm to come to the former client. I would end the conversation with the former client by thanking them for understanding and let him know that if he feels as if he needs any additional support to seek out a professional counselor. When responding to a former client in this type of situation, it is vital that I am clear and firm, while also ensuring that I am being compassionate towards the former client.
